Terms of Service & Formula Licensing

1. About These Terms

These Terms of Service ("Terms") govern your use of nextlabshq.com and any formulas, guides, or membership services purchased or accessed through it ("Next Labs," "we," "us," "our"). Next Labs is operated by E&K Bella DOO Beograd, a company registered in Serbia.

By purchasing a formula, subscribing to membership, or otherwise using our site, you agree to these Terms. If you do not agree, please do not use our services.

2. What You're Buying - Formula Licensing

This is the most important section on this page, so please read it carefully.

When you purchase a formula from Next Labs, this is a one-off purchase that grants you full rights to manufacture and sell finished cosmetic products based on that formula, for as long as you like, with no ongoing fees or membership requirement. Formulas are licensed on a non-exclusive basis - meaning the same formula may also be purchased and used by other customers.

Once purchased, you may:

Use the formula to manufacture finished cosmetic products under your own brand, indefinitely
Sell those finished products commercially, with no restriction on volume or duration
Provide the formula to a contract manufacturer solely for the purpose of producing your finished products

You may not, without our prior written consent:

Resell, redistribute, sublicense, or share the formula document or its contents with any third party other than a contract manufacturer engaged to produce your own finished products
Claim the formula was developed exclusively for your brand
Use the formula document itself (as opposed to products made from it) to build a competing formula-selling business

If you would like a formula that is genuinely unique to your brand - not sold to any other customer - this is not available through the standard formula library. Please contact us to discuss custom formulation, which is developed exclusively for you from the outset.

3. Membership

Membership plans provide access to discounted formula pricing and, depending on tier, additional benefits such as early access, group Q&A sessions, or direct formulation guidance. Membership does not include free formulas - formulas are purchased separately, at the discounted rate applicable to your membership tier.

Membership is billed on a recurring monthly basis and can be cancelled at any time; your access and discount rate remain active until the end of the billing period already paid for.

4. Payment and Refunds

All prices are listed in USD unless otherwise stated. Payment is processed securely through our third-party payment providers at the time of purchase.

Because formulas and guides are digital products delivered instantly upon purchase, we do not offer refunds once a formula or digital product has been downloaded or accessed, except where required by applicable consumer law. If you believe you have received a faulty or incorrect file, please contact us at hello@nextlabshq.com and we will work with you to resolve the issue.

5. No Warranty on Manufacturing Outcomes

Formulas provided by Next Labs are developed based on established cosmetic formulation practice, but Next Labs makes no guarantee regarding the outcome of any manufacturing process undertaken by you or your contract manufacturer. You are solely responsible for:

Confirming the formula's compliance with the cosmetic regulations of your target market(s) prior to sale
Any stability testing, preservative efficacy testing, or other testing required before bringing a finished product to market
Ensuring accurate and compliant labelling of your finished product
The safety, quality, and performance of the finished product manufactured using the formula

Next Labs is not liable for any loss, damage, or regulatory issue arising from the manufacture, marketing, or sale of finished products based on formulas purchased through this site.

6. Intellectual Property

All content on nextlabshq.com - including formulas (subject to the licence terms above), guides, branding, and website content - is the property of Next Labs / E&K Bella DOO Beograd and protected by applicable intellectual property laws, except where a formula's IP has been separately and explicitly transferred to a customer via a signed agreement.

7. Limitation of Liability

To the maximum extent permitted by law, Next Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website, formulas, or services.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
